Conflicto de competencia suscitado entre los Juzgado Cuarto Civil Municipal y Tercero Administrativo Oral del Circuito de Villavicencio.
En este caso se configuró un conflicto aparente de competencia, toda vez que el Juzgado Municipal aplicó las reglas de reparto contenidas en el Decreto 1069 de 2015 y modificadas por el Decreto 1983 de 2017, para abstenerse de asumir el conocimiento de la tutela de la referencia.
Considera la Corte que con dicha actuación le otorgó un alcance inexistente a las disposiciones contenidas en dicho instrumento jurídico, las cuales, lejos de integrar mandatos procesales en materia de competencia son apenas pautas de reparto.
Concluye la Sala que la autoridad competente para resolver la acción de tutela formulada es el despacho judicial a quien primero le fue repartida la misma, esto es, el Juzgado Cuarto Civil Municipal de Villavicencio.
Se ordena la remisión del expediente a dicho juzgado, para que de manera inmediata tramite y adopte la decisión de fondo a que haya lugar.
Así mismo, se le hace una advertencia para que en lo sucesivo se abstengan de suscitar conflictos de competencia con base en las reglas de reparto, en tanto ello desconoce la jurisprudencia reiterada y vinculante de la Corte Constitucional.
